Terms and Conditions

Translation for convenience. The German version of these General Terms and Conditions is the legally binding one; in the event of any discrepancy, the German text prevails.

General Terms and Conditions

  1. All offers made by EBRO IMMOBILIEN GMBH are subject to change and non-binding. Errors and prior sale or letting remain reserved.

    All property-related information is based exclusively on information provided by the seller or landlord and has not been verified for accuracy or completeness. It is the client’s responsibility to verify the accuracy and completeness of this information. EBRO IMMOBILIEN GMBH merely passes on the information provided and accepts no liability for its accuracy, except in cases of intent or gross negligence on the part of EBRO IMMOBILIEN GMBH.

  2. Upon conclusion of the contract, the commission amounts specified in the respective offer shall become due and payable.

  3. Entitlement to commission arises as soon as a contract is concluded as a result of the introduction or brokerage services provided by EBRO IMMOBILIEN GMBH. The client undertakes to inform EBRO IMMOBILIEN GMBH without delay if a contract concerning a property offered by EBRO IMMOBILIEN GMBH has been concluded and to disclose the terms and conditions of that contract. Entitlement to commission shall also arise if the client purchases or rents a property from the same seller or landlord other than the property originally introduced, provided that the transactions are economically equivalent.

  4. If the recipient is already aware of the property introduced, the recipient must notify EBRO IMMOBILIEN GMBH without delay and provide supporting evidence.

  5. All communications and documents provided by EBRO IMMOBILIEN GMBH, including details identifying the property and all property-related information, are confidential and intended solely for the client’s personal use. They may not be disclosed to third parties without the prior express written consent of EBRO IMMOBILIEN GMBH.

    If the client breaches this obligation and the third party to whom the property details and/or property-related information were disclosed enters into the transaction directly, the client shall be liable to pay a contractual penalty equal to 50% of the full agreed commission. The full commission shall become due and payable upon conclusion of any principal contract resulting from such disclosure.

  6. EBRO IMMOBILIEN GMBH is entitled to provide commission-based services to the other contracting party as well.

  7. The liability of EBRO IMMOBILIEN GMBH shall be limited to cases of intent or gross negligence. This limitation of liability shall not apply to injury to life, body or health, or to liability arising from a breach of material contractual obligations by EBRO IMMOBILIEN GMBH.

  8. The place of performance and—provided that the recipient is a merchant—the place of jurisdiction shall be Munich. The contractual relationship shall be governed by German law.

  9. All images and graphic representations contained in this brochure are the property of EBRO IMMOBILIEN GMBH and may neither be used nor disclosed to third parties.

  10. Should one or more of the foregoing provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
